FanGen Nationwide Contest Rules (Void Where Prohibited)

1. Eligibility:

• Contest is open to legal residents of the United States, aged 18 or older, unless otherwise specified. Contest is void where prohibited by law.

• Employees, affiliates, and immediate family members of FanGen and its subsidiaries are not eligible to participate.

2. No Purchase Necessary:

• No purchase is necessary to enter or win. A purchase will not increase your chances of winning.

3. Entry Period:

• Contest begins on Sunday, October 27, and ends on Thursday, October 31, at Midnight. All entries must be submitted by Thursday, October 31, at 11:59 PM to be eligible.

4. How to Enter:

• Participants must create and submit a video on one of four major social networks: TikTok, Instagram, Snap, or YouTube, and post using the submission form on the challenge channel.

• No limit of entries per person!

5. Content Restrictions:

• Submissions must be original content created by the entrant and can incorporate third-party material as permitted within fair use.

• Submissions must not contain any offensive, defamatory, or illegal material.

• Entrants retain ownership of their content but grant FanGen the right to use, distribute, and display submissions across its platforms.

6. Winner Criteria:

• Submissions will be submitted into a random lottery, one of which will win a $100 cash prize.

• Additionally, video submissions with over 100K views will win a $100 cash prize. In the event that several submissions exceed 100K, the submission with the highest view count will be deemed the winner.

• Winners will be notified within 5 days of the contest closing.

7. Prizes:

• The prizes for the contest include two $100 cash prizes for submitted videos within the period.

• Prizes are non-transferable, and no cash alternatives will be offered.

8. Winner Notification:

• Winners will be notified via Discord direct message and email.

• If a winner does not respond within five days, an alternate winner may be selected.

9. Taxes:

• Winners are responsible for any taxes associated with the prize. Winners earning more than $600 in total prizes from FanGen in a calendar year must submit a W-9 form for tax purposes, and FanGen will issue a 1099-MISC as required by law.

10. Publicity:

• By participating, entrants agree to allow FanGen to use their name, likeness, and submission for promotional purposes without additional compensation, unless prohibited by law.

11. Disqualification:

• FanGen reserves the right to disqualify any participant found to be tampering with the entry process or violating these official rules.

12. Limitation of Liability:

• FanGen is not responsible for technical errors, lost or late submissions, or any damages resulting from participation in the contest. By participating, entrants agree to release and hold harmless FanGen, its affiliates, directors, officers, and employees from any claims, liabilities, or damages, including but not limited to any direct, indirect, incidental, or consequential losses, arising out of participation in the contest or the acceptance, possession, or use of any prize.

13. Governing Law:

• The contest and these official rules will be governed by and construed in accordance with the laws of the state of California, without regard to its conflict of law principles.

14. Arbitration Clause:

• Any disputes or claims relating to the contest, including but not limited to claims regarding the interpretation or application of these rules, will be resolved by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will be conducted in Los Angeles, California. By participating in the contest, entrants agree to waive their right to a trial by jury or to participate in a class action. The arbitrator’s decision will be final and binding.

15. Void Where Prohibited:

• This contest is void where prohibited by law. FanGen reserves the right to cancel, suspend, or modify the contest in any state or jurisdiction where required by law or where unforeseen circumstances arise that prevent the fair administration of the contest.

16. Miscellaneous:

• FanGen reserves the right to cancel, suspend, or modify the contest if unforeseen circumstances arise, including technical failures or legal restrictions that may affect the fairness or integrity of the contest.
